Terms of Use

Agreement to These Terms

Welcome to Hushfield. These Terms of Use ("Terms") constitute a legally binding agreement between you and Aradhya Singh, operating Hushfield ("Hushfield," "we," "us," or "our"), governing your access to and use of the Hushfield mobile application for iOS and Android, including all content, features, and functionality provided through or in connection with the application (collectively, the "App").

By downloading, installing, accessing, or using Hushfield, you agree that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, located at https://hushfield.xyz/privacy/. If you do not agree to these Terms, you must not download, install, access, or use the App.

About Hushfield

Hushfield is a mobile application designed to provide ambient soundscapes, background noise masking, and sound mixing features intended to support personal sleep, focus, relaxation, and overall auditory ambience.

Eligibility and Minimum Age

You must be at least 13 years of age (or the minimum legal age of digital consent in your jurisdiction, whichever is higher) to use Hushfield. By using the App, you represent and warrant that you meet this age requirement. If you are under the legal age of majority in your jurisdiction, you represent that you are using the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

License to Use Hushfield

Subject to your compliance with these Terms, Hushfield grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the App on a mobile device that you own or control, solely for your personal, non-commercial use.

Except as expressly permitted in these Terms or by applicable law, you shall not:

  • Copy, modify, adapt, translate, or create derivative works of the App or any audio, artwork, visual elements, or content contained therein;
  • Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the App or any part thereof;
  • Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the App or any audio assets to any third party or public audience;
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the App or its content;
  • Frame or mirror any part of the App without express written authorization.

Subscriptions and Billing

Hushfield offers certain features and content on a paid subscription basis ("Pro Access").

  • Subscription Options: Subscriptions are offered on a recurring Monthly or Annual billing basis. We do not offer lifetime, family, enterprise, or direct credit card billing plans.
  • Third-Party Payment Processing: All purchases, payments, and billing for Hushfield subscriptions are processed exclusively through the Apple App Store (for iOS devices) or Google Play Store (for Android devices), governed by the respective store's terms and billing policies. Hushfield does not collect, handle, or store your payment card numbers, banking information, or direct billing details.
  • RevenueCat Service: We utilize RevenueCat, a third-party subscription management service, to validate purchase receipts, manage subscription entitlements, and grant access to Pro features.

Free Trials

  • Eligibility and Duration: A 3-day free trial may be offered exclusively on the Annual subscription plan for eligible iOS users (where configured and made available via the Apple App Store). Free trials are not available on Monthly subscription plans or on non-eligible accounts or platforms.
  • Trial Conversion: Unless cancelled at least 24 hours prior to the end of the 3-day free trial period, the trial will automatically convert into a paid, auto-renewing Annual subscription, and your Apple ID account will be charged the applicable Annual subscription fee.

Automatic Renewal

  • Auto-Renewal Notice: All Hushfield subscriptions (Monthly and Annual) automatically renew at the end of each billing period (monthly or annually) unless cancelled by you at least 24 hours before the end of the current billing cycle.
  • Billing Charge: Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current subscription period at the prevailing subscription rate shown at the time of purchase (or as updated in accordance with store policies).

Cancellation

  • Store-Managed Cancellation: You may cancel your Hushfield subscription or free trial at any time through your Apple App Store or Google Play Store account settings:
    • iOS: Open your device Settings → Tap your Apple ID → Subscriptions → Select Hushfield → Tap Cancel Subscription.
    • Android: Open Google Play Store → Tap Profile Icon → Payments & Subscriptions → Subscriptions → Select Hushfield → Tap Cancel Subscription.
  • Effect of Deleting the App: Deleting or uninstalling the Hushfield application from your device does not cancel your active subscription or free trial. You must cancel the subscription via your store account settings to stop future recurring charges.
  • Access Following Cancellation: If you cancel your subscription, you will continue to have access to Pro features until the end of your current paid billing period or active trial period. Upon expiration, your access will revert to free-tier availability.

Refunds

  • Store-Governed Refunds: Because all subscription transactions are processed by Apple or Google, all refund requests, chargebacks, and payment disputes are governed exclusively by the refund policies and procedures of the Apple App Store or Google Play Store.
  • No Direct Refunds: Hushfield does not process payments directly and cannot issue direct monetary refunds to users. If you seek a refund, you must submit your request directly to Apple or Google through their respective support channels.

Restore Purchases

If you reinstall Hushfield, switch devices on the same operating system platform, or lose access to Pro features while having an active subscription, you may restore your subscription using the "Restore Purchases" option available in the App's settings or paywall screen. Restoration requires an active internet connection and login to the Apple ID or Google Play account used for the original purchase.

Subscription Access

  • Single Entitlement Model: Hushfield operates a single entitlement model (hushfield_pro). Access to Pro content, premium soundscapes, and advanced mixing tools is granted on an all-or-nothing basis during active subscription terms.
  • Post-Expiration Access: Upon subscription expiration or cancellation, access to Pro soundscapes and premium features will be restricted. However, your locally created saved mixes, favorites, and settings will remain saved on your device and will become accessible again should you reactivate Pro Access.

Hushfield Content and Intellectual Property

  • Ownership: All rights, title, and interest in and to the App—including all audio tracks, sound recordings, ambient soundscapes, artwork, graphics, user interface designs, software code, branding, and text—are owned by or licensed to Aradhya Singh / Hushfield and are protected by applicable Canadian and international copyright, trademark, trade secret, and intellectual property laws.
  • No License Granted Except Personal Use: Nothing in these Terms grants you any right, title, or interest in Hushfield's intellectual property other than the limited personal use license expressly provided herein.

Saved Mixes and Local Data

  • Local Soundscape Configurations: Hushfield permits you to customize and save custom ambient mixes ("Saved Mixes"). Saved Mixes consist solely of local configuration data (such as sound selections, layer combinations, volume levels, and mute states) stored directly on your mobile device.
  • User Control of Local Data: You retain full control over your local data. Hushfield does not claim ownership of your local mix configurations. Saved Mixes are stored locally via device storage (AsyncStorage) and are never uploaded, transmitted, or hosted on external servers by Hushfield.
  • No UGC Hosting: Hushfield does not host, publish, broadcast, or facilitate public sharing of user-generated content, public profiles, comments, or forums.

Acceptable Use

You agree to use Hushfield only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any manner that violates any applicable local, provincial, national, or international law or regulation;
  • Extract, scrape, capture, record, broadcast, rebroadcast, stream, redistribute, or commercially exploit any audio tracks, artwork, or content from Hushfield;
  • Circumvent, disable, override, or interfere with security features, entitlement checks, or digital rights management mechanisms within the App;
  • Interfere with or disrupt the operation, servers, networks, or content delivery infrastructure (including our content distribution CDN) associated with the App;
  • Attempt to gain unauthorized access to any system, network, or server connected to the App.

Availability, Updates, and Changes

  • Service Availability: We strive to keep Hushfield available and operational. However, access to the App or specific remote sound catalogs may occasionally be interrupted or unavailable due to scheduled maintenance, system updates, network failure, or circumstances beyond our reasonable control.
  • Catalog Updates: Audio assets, soundscape collections, and artwork may be added, modified, updated, or removed from the App catalog from time to time at our sole discretion. We do not guarantee permanent availability of any individual audio track.
  • Offline Capabilities: The App supports caching and local playback of downloaded audio assets. Previously downloaded content may remain available offline in accordance with local storage capacity and cache policies.

Third-Party Services

Hushfield integrates with or relies upon third-party platforms and infrastructure services to deliver its functionality:

  • RevenueCat: For subscription receipt validation and entitlement management. For more details, see RevenueCat's Privacy Policy.
  • Apple App Store & Google Play Store: For app distribution, payment processing, and subscription management. For more details, see Apple's Privacy Policy and Google's Privacy Policy.
  • Cloudflare / Content Delivery Network (CDN): For hosting and serving public sound catalogs, audio files, and artwork (media.hushfield.xyz). For more details, see Cloudflare's Privacy Policy.

Your use of third-party platforms is subject to the respective terms and privacy policies of those third parties. Hushfield is not responsible for the performance, availability, or terms of third-party services.

Privacy

Your privacy is important to us. Our Privacy Policy explains how technical data and subscription validation operate in connection with the App. Please review our Privacy Policy at https://hushfield.xyz/privacy/. By using Hushfield, you acknowledge that you have read and understood our Privacy Policy.

Wellness and No Medical Advice Disclaimer

  • General Wellness Only: Hushfield is designed, positioned, and provided strictly as a general ambient audio and lifestyle wellness tool intended to support relaxation, personal focus, sleep environment ambience, and background noise masking.
  • NOT Medical or Healthcare: HUSHFIELD IS NOT A MEDICAL DEVICE, MEDICAL APPLICATION, DIAGNOSTIC TOOL, OR HEALTHCARE SERVICE. THE APP IS NOT DESIGNED, INTENDED, OR LICENSED TO DIAGNOSE, TREAT, PREVENT, CURE, OR MITIGATE ANY MEDICAL OR HEALTH CONDITION, INCLUDING BUT NOT LIMITED TO INSOMNIA, SLEEP DISORDERS, ANXIETY DISORDERS, DEPRESSION, TINNITUS, OR OTHER PHYSICAL OR MENTAL HEALTH CONDITIONS.
  • Consult a Professional: Always seek the advice of a qualified physician or healthcare provider regarding any medical condition or health objectives. Never disregard professional medical advice or delay seeking it because of information or soundscapes experienced through Hushfield.

Safe Use of Audio

  • Operational Safety Warning: Listening to ambient sounds or audio content at high volumes or while performing tasks requiring full alertness can pose safety risks.
  • No High-Risk Use: DO NOT USE HUSHFIELD, WEAR HEADPHONES, OR LISTEN TO SOUNDSCAPES AT VOLUMES THAT OBSCURE ENVIRONMENTAL AWARENESS WHILE DRIVING A MOTOR VEHICLE, OPERATING MACHINERY, BICYCLING, RUNNING IN TRAFFIC, OR ENGAGING IN ANY ACTIVITY WHERE AUDITORY ATTENTION IS REQUIRED FOR SAFETY.
  • Hearing Protection: Prolonged exposure to high audio volumes can cause permanent hearing damage. Please maintain safe listening volume levels.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUSHFIELD IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY. ARADHYA SINGH AND HUSHFIELD EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON STATUTORY CONSUMER RIGHTS, SO SOME OR ALL OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARADHYA SINGH, OPERATING HUSHFIELD, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP OR ITS CONTENT.

NEITHER ARADHYA SINGH NOR HUSHFIELD ASSUMES ANY RESPONSIBILITY OR LIABILITY FOR ANY ACTIONS, OMISSIONS, OR BILLING PRACTICES OF APPLE, GOOGLE, REVENUECAT, OR THIRD-PARTY SERVICE PROVIDERS.

NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT LIABILITY THAT CANNOT BE LAWFULLY EXCLUDED OR LIMITED UNDER APPLICABLE CONSUMER PROTECTION LAWS IN YOUR JURISDICTION.

Termination and Restriction of Use

  • User Discontinuation: You may terminate your use of Hushfield at any time by uninstalling the App and cancelling any active subscriptions via your App Store or Google Play account settings.
  • Local Data Deletion: You may permanently erase your local app data, saved mixes, favorites, and settings at any time using the "Delete all local data" option in the App settings.
  • Right to Restrict Access: We reserve the right to restrict, modify, or discontinue access to remote catalog services or App features at our discretion, subject to applicable law and platform store policies regarding active subscriptions.

Governing Law

These Terms and any dispute, claim, or controversy arising out of or in connection with Hushfield or these Terms shall be governed by, construed, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Dispute Resolution

Any dispute, legal action, suit, or proceeding arising out of or relating to these Terms or your use of Hushfield shall be brought exclusively in the courts of competent jurisdiction located in the Province of Ontario, Canada, and you hereby irrevocably consent and submit to the personal jurisdiction and venue of such courts.

Changes to These Terms

We reserve the right to modify, update, or replace these Terms from time to time. When we make changes, we will update the "Effective Date" at the top of these Terms and post the updated Terms at https://hushfield.xyz/terms/. Continued access to or use of Hushfield after any such changes become effective constitutes your acceptance of the revised Terms.

Severability and Miscellaneous

  • Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect.
  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aradhya Singh operating Hushfield regarding your use of the App, superseding any prior agreements or communications.
  • No Waiver: No failure or delay by Hushfield in exercising any right or remedy under these Terms shall operate as a waiver thereof.
